General Terms and Conditions of Sale

These general terms and conditions of sale (hereinafter the “GTC”) govern the seasonal rental of the furnished tourist accommodation (lodges and villa) offered under the Tiki Paradise Lodge brand, in Sainte-Anne (Guadeloupe), by the company CARIBBEAN TRIP (SARL), whose registered office is located at 14 Route de Fonds Vapeur, 97180 Sainte-Anne. Any reservation implies the tenant’s full and complete acceptance of these GTC.

Reservations are made on the site tikiparadiselodge.com, through the online booking platform, or directly with the owner. Contact: bcauzot@gmail.com — Phone: +590 690 16 05 39.

Article 1 — Purpose

This rental is granted as temporary and leisure accommodation. The tenant may not claim any right to remain on the premises at the end of the reserved period. Carrying out any commercial, professional or craft activity on the rented premises is prohibited.

Article 2 — Reservation and Payment

To be taken into account, every reservation must be accompanied by the payment of a deposit:

  • Deposit: a deposit of 30% of the amount of the stay is paid at the time of booking (or within 5 working days) in order to validate it.
  • Balance: the balance of the stay is paid at the latest 15 days before arrival, by bank transfer or credit card via the booking platform, or on the day of arrival by credit card.
  • Participants: the surname, first name and age of all participants, including newborns, are provided at the time of booking; any incorrect information may result in the cancellation of the reservation.
  • Minors: for safety and health reasons, minors not accompanied by one of their legal representatives within the meaning of article 382 of the French Civil Code are not admitted.

No promotion may be applied to a reservation already paid, in whole or in part.

Article 3 — Price, Fees and Tourist Tax

  • Price: prices are indicated in euros, all taxes included.
  • Cleaning fee: a mandatory end-of-stay cleaning fee is charged; its amount is specified at the time of booking (for guidance: €40 for the 2-person lodges and €50 for the 4-person lodge).
  • Tourist tax: a tourist tax of €2.50 per adult per day is due; minors are exempt.

Article 4 — Termination Clause

In the absence of payment of the rental balance before or on the day of entry into the premises, the contract shall be terminated automatically, at the owner’s discretion, without judicial formality, the deposit remaining acquired by the owner.

Article 5 — Security Deposit

A security deposit is required in order to cover any damage: €500 for the lodges and €700 for the villa. It is taken as a pre-authorisation on the tenant’s credit card (this is not a charge) or by cheque, and is released within 7 days following departure.

The deposit is returned less, where applicable, any repair, cleaning or unpaid ancillary service costs. Any lost or damaged key is charged to the tenant. The tenant is responsible for any broken or damaged item and for damage caused to the facilities; if the security deposit proves insufficient, the tenant undertakes to make up the difference.

Article 6 — Conditions of Occupancy

The tenant undertakes to:

  • occupy the premises peacefully and use them in accordance with their intended purpose, without modifying the arrangement of the furniture and the premises;
  • respect the accommodation’s capacity; in the event of exceeding it, the owner may require the tenant to leave without refund and retain the security deposit;
  • not assign or sublet the premises, even free of charge, without the owner’s written consent;
  • not throw anything into the pipes that could block them, failing which the cost of restoring service will be at the tenant’s expense;
  • report any complaint relating to the facilities within 48 hours of entering the premises;
  • notify the owner as soon as possible of any damage; repairs made necessary by the tenant’s negligence or a lack of maintenance are at the tenant’s expense;
  • authorise the owner, or any mandated third party, to carry out any urgent repairs during the stay, without reduction of rent;
  • avoid any noise or behaviour likely to disturb the neighbourhood;
  • refrain from smoking in the accommodation, which is non-smoking; a deduction from the security deposit may be made in the event of non-compliance;
  • maintain the accommodation and return it in a good state of cleanliness; damaged inventory items are charged at their replacement value.

The tenant waives any recourse against the owner in the event of theft or damage on the rented premises. The allocation of accommodation is carried out according to availability.

Article 7 — Arrival and Departure

Arrivals take place from 3 p.m. and departures at the latest by 10 a.m. On departure, the tenant returns the accommodation clean: dishes washed and put away, cupboards and refrigerator emptied, microwave and refrigerator cleaned in the event of spills, rubbish placed in the containers. A deduction from the security deposit will be made if any of these items is not respected.

Article 8 — Inventory of Fixtures and Condition Report

An inventory of fixtures is drawn up on entry. In the absence of an inventory signed by both parties, the tenant may contest it within 48 hours following the handover of the keys; failing any contestation within this period, the inventory drawn up by the owner is deemed accepted.

An inventory of fixtures and an inventory of contents are drawn up at the end of the rental. The return of the keys does not entail any waiver of the rental repairs attributable to the tenant. In the absence of an inventory of fixtures, the tenant is presumed to have received the premises in good condition and must return them as such, unless proven otherwise (article 1731 of the French Civil Code).

Article 9 — Equipment Provided

The following are provided and included in the stay: household linen (sheets, bath towels, bath mats, tea towel, fouta); a fully equipped kitchen (refrigerator, hob, microwave, toaster, kettle, glassware); Wi-Fi and a hairdryer. A washing machine is available in the common area of the guesthouse and in the villa, to be used sparingly.

Article 10 — Air Conditioning

As part of an eco-responsible approach, the air conditioners must only be used with doors and windows closed and must not be left running when no one is present. The recommended temperature is 25 °C. The owner or their representative reserves the right to switch off the air conditioning when the accommodation is unoccupied. In the event of non-compliance, a sum of €10 per air conditioner may be charged.

Article 11 — Animals

Pets are not admitted; their presence would result in the immediate termination of the contract.

Article 12 — Staff and Emergency Number

The supervisory and maintenance staff work according to the posted schedule. The maintenance of the green spaces is carried out 1 to 2 times per month and that of the swimming pools at least once a week. Emergency number: +590 690 16 05 39.

Article 13 — Cancellation Conditions

Cancellation by the Tenant

Any cancellation must be notified by email before entry into the premises. The refund is made according to the following scale, calculated on the amount of the reservation:

  • more than 30 days before arrival: full refund;
  • between 29 and 15 days before arrival: 50% refund;
  • between 14 and 7 days before arrival: 25% refund;
  • less than 7 days before arrival: no refund.

The deposit remains acquired by the owner in cases where this scale does not provide for a full refund. In the event of no-show, after a period of 24 hours, the contract is considered null and void: the deposit and the balance remain acquired by the owner, who may dispose of the accommodation. In the event of interruption of the stay or early departure, no refund is made.

Cancellation by the Owner

If the owner cancels a reservation, they undertake to refund the deposit paid and to offer an equivalent or superior replacement solution.

Exceptional Health Circumstances

In the event of impossibility to travel linked to a health crisis (in particular Covid-19), CARIBBEAN TRIP shall issue a credit note valid for 12 months (less the deposit) when, within the 7 days preceding arrival, the customer is unable to reach the destination due to a decision by a public authority (lockdown, mandatory quarantine, prohibition of travel for non-essential reasons), or when CARIBBEAN TRIP is unable to accommodate the customer in conditions compliant with health measures. This option does not apply to circumstances relating to the customer’s personal situation, which are subject to the standard cancellation conditions; a change of transport arrangement decided by a private operator does not give rise to this right.

Article 14 — Cancellation Insurance

The tenant may take out, at the time of booking, cancellation insurance allowing them to cancel due to an external, sudden, unforeseeable event beyond their control. Its cost is €40 for the 2-person lodges and €60 for the 4-person lodge and the villa. Subject to this sole condition, the tenant may benefit from a full refund of the amount of their reservation.

Article 15 — Right of Withdrawal

In accordance with article L221-28 of the French Consumer Code, the right of withdrawal does not apply to accommodation services provided on a specific date or according to a specific frequency. The reservation is therefore firm and final as soon as it is confirmed, subject to the cancellation conditions provided for in article 13.

Article 16 — Special Offers

Certain promotional offers (in particular 2-night stays from Friday to Sunday or Saturday to Monday) are non-cancellable and non-refundable and do not apply to the Surf House villa. For these offers, the full amount of the stay is paid at the time of booking; the cleaning fees (€40 for the 2-person lodges, €50 for the 4-person lodge) and the tourist tax remain due. The other provisions of these GTC remain applicable.

Article 17 — Liability

CARIBBEAN TRIP cannot be held liable for damage resulting from the actions of the tenant, their companions or a case of force majeure. The tenant is responsible for damage caused to the rented property during the stay.

Article 18 — Personal Data

The tenant’s personal data is processed in accordance with the Site’s privacy policy, available at tikiparadiselodge.com. The tenant has, in particular, rights of access, rectification and erasure of their data, which may be exercised at bcauzot@gmail.com.

Article 19 — Complaints and Mediation

Any complaint may be sent to bcauzot@gmail.com. In accordance with articles L611-1 et seq. of the French Consumer Code, the consumer tenant may, after a written complaint that has remained unsuccessful, use a consumer mediator free of charge with a view to the amicable resolution of the dispute. They may also use the European online dispute resolution platform: https://ec.europa.eu/consumers/odr.

Article 20 — Applicable Law and Disputes

These GTC are subject to French law. Failing an amicable resolution, any dispute falls within the jurisdiction of the French courts.
